How Much Does a Trust Sale Realtor Cost in California?

By William B. Plevy, California Real Estate Broker · DRE #01956776 Updated June 2026
The Short Answer

California real estate commissions are negotiable and not standardized. Trust sale agent commissions typically range from 4% to 6% of the sale price, consistent with standard residential commissions. These fees are paid from the trust's sale proceeds at closing, not out of pocket by the trustee. Using Wolf Allies to find your agent costs nothing and never affects the commission you pay.

Commission rates in California real estate have never been legally fixed, and recent industry changes have made this even more explicit. What a trust sale agent charges depends on the property's value, the complexity of the transaction, local market norms, and what you negotiate. On a $1.5 million property at a 5% commission, the total agent compensation is $75,000, split between the listing agent and the buyer's agent.

For trust and probate sales, commission is an allowable estate expense. It is paid from the proceeds of the sale before distribution to beneficiaries, the same way it would be paid in any real estate transaction. Beneficiaries receive their distributions after all sale costs, including commissions, are deducted.

The question of whether specialized trust sale agents charge more than general residential agents is nuanced. Some do charge slightly higher commissions in recognition of the additional complexity. Others charge standard rates. What matters is not the commission rate in isolation but the net proceeds the agent is able to generate for the trust. An agent who charges 5% and achieves full market value is worth more to the trust than an agent who charges 4% and achieves 90% of market value.

Wolf Allies connects trustees and executors with specialist agents at no cost to the trust. Under California law, an agent cannot charge a seller more because of a broker referral arrangement, the commission is identical whether you found your agent through Wolf Allies or on your own. Our referral fee comes from the agent's side of the transaction, completely separate from what you pay.

As trustee, your obligation is to select an agent whose qualifications give the trust the best opportunity to sell at fair market value. Commission rate is one factor in that analysis, but agent experience, local market knowledge, and track record in trust sales are at least as important.
